H.J. Res. 100 is the legislation that implements the tentative agreement earlier rejected by BMWED as the binding contract resolving this bargaining round. The passage of this legislation ends the bargaining dispute and prevents a legal strike.

am calling on Congress to pass legislation immediately to adopt the Tentative Agreement between railroad workers and operators – without any modifications or delay – to avert a potentially crippling national rail shutdown.

National Division Town Hall Meetings |
|
The BMWED National Division will conduct a series of Town Hall meetings with President Tony Cardwell, other officers, and staff to discuss the Tentative Agreement and answer questions from the members.
Burlington System Division members working on BNSF are encouraged to participate in the BNSF-specific Town Hall on Thursday, September 22nd, at 7:00 PM Central Time.

3 Unions Reach Tentative Agreement - Others Remain in Bargaining |
|
Since the PEB’s recommendations came out, BMWED has returned to bargaining with the NCCC and each railroad to find a voluntary resolution and a tentative contract. Issues surrounding the exact way the PEB’s recommendations affect away from home expenses for each property have been discussed. There have been no major breakthroughs in negotiations at this time.

National Bargaining enters Mediation July 27th |

The BMWED/SMART-MD coalition will enter Mediation with the NCCC on Tuesday, July 27th, 2021.
Mediation is the next step in collective bargaining under the Railway Labor Act (RLA), after Direct Negotiations. The National Mediation Board (NMB) will assist both parties in reaching voluntary agreement or, failing that, proffer voluntary, but binding, arbitration.

Understanding Collective Bargaining under the RLA |
|
The attached chart shows how bargaining works under the Railway Labor Act (RLA). The process prescribed by law for railroads and unions like ours is much different than what is experienced by unions under the National Labor Relations Act. The entire process is designed to avoid disruptions to commerce (whether by strikes or lockouts).
